Grocer Loses Bid to Block NLRB Case Over Alleged Agency Flaws

A federal district court rejected a California-based Korean grocery chain’s request to block the National Labor Relations Board from moving forward on an unfair labor practice case.

Hannam Chain USA Inc. failed to show it would be irreparably harmed by the alleged constitutional problems with the NLRB’s structure or legal deficiencies with its top lawyer’s appointment, ruled Timothy Kelly, a Trump appointee to the US District Court for the District of Columbia.

The decision illustrates how the injury requirement can stymie employer attempts to immediately halt NLRB proceedings via a lawsuit against the agency.
