Google’s Challenge to Joint Employer Ruling Heads to Ninth Cir.

The US Court of Appeals for the Ninth Circuit will decide whether Google LLC is a joint employer with Accenture Flex, a blow to the tech company which will now have to argue its case before a panel that has largely sided with the NLRB.

The Judicial Panel on Multidistrict Litigation’s Thursday assignment comes after both Google and the Alphabet Workers Union-Communications Workers of America filed rival petitions in separate circuit courts challenging a National Labor Relations Board decision. The panel’s decision is based on a random lottery process that gives both parties an equal chance at success.
