The Genetic Information Nondiscrimination Act of 2008 has banned employers from obtaining or using worker genetic information for over a decade. But in that time, not one lawsuit alleging that an employer used genetic information to discriminate against a worker has successfully made its way through the courts.
Court Rarity: The Equal Employment Opportunity Commission hasn’t been extremely active with bringing GINA lawsuits on behalf of workers. The agency has brought only 12 of these lawsuits since 2008, and none since 2017. The GINA charges the agency receives from workers each year are a small fraction of the total.
