Free Speech Challenge to Daniel’s Law Faces Long Odds at 3rd Cir.

An attempt to convince the Third Circuit Tuesday that New Jersey’s privacy shield for law enforcement, legal officials, and their family members is facially unconstitutional will likely face headwinds.

Daniel’s Law allows protected individuals to demand companies remove home addresses or unlisted telephone numbers from their websites. A coalition of data brokers and other companies that collect and publish personal information say amendments to that law burden their free speech rights.
