A New York federal appeals court declined to revive a former Fox News producer’s lawsuit claiming the network condoned sexual preying, harassment, and rape by an ex-anchor and then fired her after she reported the misconduct.
Jennifer Eckhart failed to show that Fox News knew about Ed Henry’s alleged behavior, a three-judge panel of the US Court of Appeals for the Second Circuit held Friday. Evidence also showed that once the network learned of Eckhart’s allegations, it terminated Henry, the court said in affirming summary judgment to Fox News on Friday.
