Fox Digital’s Win in Editor’s Age Bias Suit Affirmed on Appeal

Fox Digital Enterprises Inc. prevailed in an age discrimination suit brought by a longtime editor who was terminated when the company reduced staff.

The California Court of Appeal, Second District, affirmed a lower court’s ruling granting Fox summary judgment on Thomas Stock-Hendel’s age discrimination claim. Stock-Hendel couldn’t prove circumstances supporting an inference of discriminatory intent, the court said Tuesday in an unpublished decision.

Stock-Hendel worked as a finishing editor at Fox from 1989 to 2018, according to the opinion. Fox reduced the number of finishing editor shifts in 2009 to reduce costs. As a result, Stock-Hendel’s schedule was reduced from ...
