Fort Worth Wins Immunity Over Officers’ Whistleblower Report

Fort Worth won its immunity bid against two former police officers who were allegedly demoted for recommending another officer be charged with perjury, after the Texas Supreme Court Friday narrowed the definition of what constitutes protected information under the Whistleblower Act.

The officers’ recommendation wasn’t a qualifying report under the Whistleblower Act. A qualifying report must provide information as opposed to mere conclusions or opinions, the high court said.

Therefore, Fort Worth didn’t waive its immunity under the act, which provides a limited waiver of sovereign immunity if government employees submit a qualifying report of an alleged law violation.
