Forensic Death Detectives Prevail in Overtime Exemption Appeal

A group of former forensic death investigators don’t fall under an overtime exemption for administrative employees, an appeals court said Tuesday, teeing their wage case up for a new trial.

The investigators produce the services offered by Forensic Pathology Services PC, so their work isn’t “administrative” under the Fair Labor Standards Act, the US Court of Appeals for the Eleventh Circuit said. The company argued that the workers fall under the exemption because part of their job is ensuring they’re legally authorized to examine and move bodies, but circuit precedent “squarely forecloses” that argument, the unpublished opinion said.
