Food Company’s Violations Trigger Rerun Vote, NLRB Judge Says

A food maker’s illegal conduct prior to a vote that a union lost at a Kentucky facility requires a rerun election, a National Labor Relations Board judge ruled.

Hearthside Food Solutions LLC committed several unfair labor practices in the critical pre-election period, including unlawfully discharging workers, more strictly enforcing its cellphone policy, and playing plant manager Dave Horn’s anti-union video in the breakroom up to and during the election, Administrative Law Judge Arthur Amchan said in his Wednesday ruling.

“The Horn video in of itself warrants the direction of a second election,” Amchan said.
