A food maker’s illegal conduct prior to a vote that a union lost at a Kentucky facility requires a rerun election, a National Labor Relations Board judge ruled.
Hearthside Food Solutions LLC committed several unfair labor practices in the critical pre-election period, including unlawfully discharging workers, more strictly enforcing its cellphone policy, and playing plant manager Dave Horn’s anti-union video in the breakroom up to and during the election, Administrative Law Judge
“The Horn video in of itself warrants the direction of a second election,” Amchan said.
