Fluor Unit Racial Slurs, Jokes Too Mild for Worker’s Bias Claims

A Fluor Corp. subsidiary secured summary judgment ending a suit alleging a Black worker endured a racially hostile work environment and faced retaliation from colleagues when he spoke up about slurs and racist jokes.

The Fluor Facility & Plant Services Inc. worker didn’t show his colleagues’ actions constituted severe or pervasive harassment, dooming his discrimination claim, the US District Court for the Western District of Kentucky said. Their conduct “simply is not severe enough” to support a coworker retaliation claim, the Wednesday opinion added.
