First Circuit Revives Whole Foods Case Over BLM Masks at Work

A former employee of Whole Foods Market Inc. will get a second shot with claims she was unlawfully fired for wearing a “Black Lives Matter” face mask, after a federal appeals court revived her case.

The Boston-based US Court of Appeals for the First Circuit on Friday vacated a ruling in favor of the supermarket chain owned by Amazon.com Inc., but only for lead plaintiff Savannah Kinzer. The three-judge panel affirmed Whole Foods’ lower court win over two other plaintiffs.
