Fingerprint Privacy Lawsuit From Illinois Worker Advances

An Illinois employee can keep pursuing claims that his employer’s fingerprint timekeeping system violates the state’s biometric privacy law, after a federal court in Illinois ruled that he properly alleged that the company acted intentionally.

The employee’s Illinois Biometric Information Privacy Act (BIPA) claims aren’t preempted by the Illinois Workers’ Compensation Act’s (IWCA) exclusive remedy provision, Judge Jorge L. Alonso of the U.S. District Court for the Northern District of Illinois said Dec. 16. The court denied Power Solutions International Inc.’s motion to dismiss on these grounds.
