A final rule to governing wages and certification of farmworkers on H-2A guest-worker visas is under review at the White House budget office, the last step before publication in the Federal Register.
The US Department of Labor published draft regulations in December 2019 for public review and comment. The agency sent the final rule (RIN 1205-AB89) to the White House Office of Information and Regulatory Affairs June 30.
In addition to addressing prevailing wage rate methodologies, the proposed rule sought to streamline the application process for H-2A visas.
