Fight Heats Up Over Court Review of Joint Employer Labor Rule

The National Labor Relations Board told a federal district judge that he lacks the authority to hear an industry challenge to its joint employer rule, arguing it belongs in federal appeals court rather than the judge’s Texas courtroom.

The NLRB is also considering pushing back the Dec. 29 effective date of its rule that expanded the standard for determining when a company jointly employs contract or franchise workers, the agency said in a motion filed Wednesday.
