A federal appeals court upheld the US Labor Department’s ability to consider a worker’s salary level when determining whether they should be exempt from federal overtime pay requirements, a win for the Biden administration.
While the Wednesday ruling from the US Court of Appeals for the Fifth Circuit involved a Trump-era overtime regulation, it clears a major legal hurdle for the new overtime rule issued by the Biden administration in April, which seeks to expand time-and-a-half pay protections to 4 million workers.
