Female Kroger Employee Fired at Age 60 to Get Job Bias Trial

The Kroger Co. may have fired a delivery worker after 38 years because of her age, 60, and because she is a woman, not for violating work rules regarding the disposal of unsold products and making purchases while on the clock, the Eastern District of Michigan ruled.

The company cited those reasons in firing Mary Sligay from her direct store delivery received position. But a jury could reject Kroger’s explanation as a pretext for age and sex bias under Michigan’s Elliott-Larsen Civil Rights Act, the court said Wednesday.
