FEMA Worker’s Time to Sue for Job Bias Unaffected by Email Snafu

A former FEMA employee’s time to sue for alleged disability bias started when he received an email regarding the agency’s final decision on his claim, not a day later when he was able to open the attachment containing the decision, the Seventh Circuit ruled.

Brian Lax’s 90 days to sue likewise weren’t tolled by his inability to open the attachment on his work-issued cell phone the day the email was received, the court said Monday, affirming the dismissal of Lax’s suit under the Rehabilitation Act.
