FedEx Must Face Worker’s Overtime Pay Claims in New Mexico Court

FedEx Ground Package System Inc. lost a bid to defeat claims it owes unpaid overtime to delivery workers in New Mexico, when a federal court rejected the company’s argument that the state’s minimum wage act never applies to hours worked out of state.

Fernandez Martinez brought a proposed class action alleging that FedEx violated state law by paying workers by the day rather than by the hour, such that the workers received no overtime pay for regularly working in excess of 40 hours per week.
