FedEx Defeats Drivers’ Class Bid on California Break Claims

A group of delivery drivers failed to convince a federal judge in California to allow them to proceed as a certified class on claims that FedEx Corp. is liable as their joint employer for state-law meal and rest break violations.

The drivers, who work for FedEx through subcontracted delivery service providers, sued in 2018. They allege that they were misclassified as independent contractors and deprived of wages, breaks, and other benefits required by California law, but only sought class certification on some of their claims, namely missed meal and rest breaks.
