A group of FBI employees will get the chance to proceed collectively with their Fair Labor Standards Act lawsuit accusing the Bureau of misclassifying about 1,000 of them as overtime-exempt.
Judge Lydia Kay Griggsby of the U.S. Court of Federal Claims granted conditional FLSA certification to the John Doe suit by “staff operations specialists” who claim the FBI fails to pay them time-and-a-half for their work in excess of 40 hours a week. The FBI allegedly began classifying them as exempt no later than 2016.
