Fast-Food Chain Operator Sues DOL Over Trump Overtime Rule

A Texas-based fast-food chain operator is asking a federal court to overturn a Trump-era rule on overtime pay requirements in an attempt to head off the Biden administration’s forthcoming rulemaking that is expected to expand time-and-a-half pay protections.

Robert Mayfield, a restaurant owner in Austin, Texas, who is represented by the libertarian public interest law firm Pacific Legal Foundation, argued in a lawsuit filed Tuesday in the US District Court for the Western District of Texas that the US Labor Department went beyond its legislative authority when issuing an overtime rule finalized by the Trump administration in 2019.
