ExxonMobil Jilted Intern’s DACA Status Dooms Class Job Bias Suit

ExxonMobil Corp. defeated a job discrimination suit by an engineering student whose internship offer was pulled, because his status as a Mexican citizen authorized to work in the U.S. under DACA isn’t protected by federal anti-bias law, the Eastern District of North Carolina ruled.

Aldo De Leon’s claims on behalf of a proposed class of similarly situated non-citizens authorized to work in the U.S. but allegedly denied internships or employment with ExxonMobil failed for the same reason, Judge Richard E. Myers II said.
