Ex-Video Game Board Members Win Reversal in Harassment Suit

Two former board members of video game developer Lab Zero Inc. convinced a California appellate court that a tweet and private conversations with coworkers discussing alleged sexual harassment by Michael Zaimont, the company’s president at the time, qualify as protected speech.

Mariel Cartwright and Francesca Esquenazi’s speech was made in connection with a public issue, and four of Lab Zero’s counterclaims in their retaliation and wrongful termination suit at least partly arise from their statements, the California Court of Appeals, Second District, ruled Tuesday.
