Ex-VA Nurse Fired for Overtime Loses Bid to Revive Age Bias Case

A nurse who alleges a Department of Veterans Affairs hospital fired her because of her age, not her decision to repeatedly work unauthorized overtime, failed to revive her discrimination case on appeal.

The nurse argued that the overtime was necessary to ensure patients received proper medical care. But she didn’t tie her termination—or any of the earlier discipline she faced for working extra hours without permission—to her age, the US Court of Appeals for the Sixth Circuit said in an unpublished opinion Thursday, affirming the lower court’s grant of summary judgment in the VA’s favor.
