A former human resources manager who says the poultry processor where she worked forced her to resign after she took protected leave to care for her injured wife is headed for trial.
The ex-Allen Harim Foods LLC worker said she was constructively discharged because she faced sex, age, and orientation discrimination and a demotion when she returned to work after caring for her wife. Disputed factual issues preclude granting the company summary judgment on her constructive discharge allegations, the US District Court for the District of Delaware said Monday.
