Equinox Misfires With Objection to Union’s Election Win

Equinox Holdings Inc. must bargain with a union that won the right to represent some of the gym operator’s employees despite one employee allegedly brandishing a pellet gun and intimidating other workers, a federal appeals court in Washington ruled.

The company objected that a National Labor Relations Board election was tainted by the employee’s actions when he brandished a pellet gun and intimidated other workers at an Equinox gym in San Francisco. But the U.S. Court of Appeals for the District of Columbia Circuit said the board acted within its discretion in upholding the union’s election victory.
