Employers Recruiting for Guestworker Visas to Go Online

Employers seeking labor certification for low-skilled, seasonal guestworkers and agricultural guestworkers would be required to upgrade to online recruiting under proposed rules released by the Department of Labor and Department of Homeland Security Nov. 8.

The H-2A and H-2B visa programs require that employers determine whether U.S. workers are available to fill open jobs before they can be certified to hire foreign workers. Currently, that requirement means employers must publish two print advertisements in a newspaper in the area of intended employment. Under the proposed rules, employers would have to post job advertisements online for at least 14 days.
