Empire Offshore Wind LLC is challenging the Interior Department’s decision to suspend its project offshore of New York.

The order “offers no plausible justification for such an extraordinary action, was issued with no notice whatsoever to Empire Wind, finds no authority in the Outer Continental Shelf Lands Act, and violates the Due Process clause of the Fifth Amendment,” according to the complaint filed Friday with the US District Court for the District of Columbia.
