A federal appeals court upheld a National Labor Relations Board decision that lieutenants at a private security company were eligible to unionize under federal labor law.
In an unpublished opinion Friday the US Court of Appeals for the Eleventh Circuit rejected claims from Universal Protection Services LLC that the lieutenants were supervisors who aren’t entitled to union representation under the National Labor Relations Act.
The case stems from a March 2024 board decision ordering the company to bargain with the union representing the lieutenants at the Turkey Point Nuclear Power Plant in Florida City, Fla.
