Elevance Unit Beats Fired Executive’s Age Discrimination Lawsuit

An Elevance Health Inc. subsidiary defeated a former executive’s age bias allegations after a federal judge ruled his inappropriate relationship with a subordinate meant he failed to show satisfactory job performance.

The Elevance Health Cos. ex-employee admitted kissing a subordinate in violation of company policy, so he didn’t show he performed satisfactory work as required for his state-law age discrimination claim to advance, the US District Court for the Eastern District of Washington said. He also failed to show that the company used this policy violation as pretext for an age-based firing, the order said.
