Electric Company Loses Tenth Circuit Challenge to Labor Deal

An Oklahoma electric company must comply with the collective bargaining agreement that was imposed on it by an arbitrator, a federal appeals court ruled.

The US Court of Appeals for the Tenth Circuit on Tuesday rejected Brent Electric Company Inc.’s argument that the CBA couldn’t be foisted on it because the contract covers permissive subjects, which it didn’t clearly agree to include in binding interest arbitration—a process that authorizes arbitrators to resolve disagreements that couldn’t be settled in negotiations.
