The National Labor Relations Board didn’t have substantial evidence supporting its ruling that a California elder-care center committed an unfair labor practice by terminating a union nurse accused of elder abuse, the D.C. Circuit ruled Dec. 10, granting review of the decision.
The NLRB’s decision didn’t sufficiently engage with any evidence that the elder-care center acted lawfully, and failed to adequately explain why it disagreed with an Administrative Law Judge’s previous findings, the U.S. Court of Appeals for the District of Columbia Circuit said in a per curiam opinion.
