A federal appeals court revived a nurse’s lawsuit challenging a Minnesota healthcare system’s decision to put her on unpaid leave after refusing to exempt her from its Covid-19 vaccination mandate because of her disability.
The US Court of Appeals for the Eighth Circuit rejected on Monday CentraCare Health System’s argument that its Covid policy is an essential function of Christine Klimek’s job with the company.
“Vaccination is not the desired result,” Judge Ralph Erickson, a Trump appointee, wrote for the court. “It is a means to an end—creating a safer workplace environment for both patients and coworkers.”
