A legal doctrine used to absolve companies of liability for allegedly biased employment actions will get a critical probe from a full federal appeals court in Minnesota, which will determine if its reach should be limited in disability discrimination cases.

The US Court of Appeals for the Eighth Circuit’s 11 active judges are set to hear oral arguments Thursday in a case involving a Hardee’s restaurant manager who said she was fired because of her diabetes. The restaurant’s owner seeks to overturn a July 2-1 decision ordering it to face an Americans with Disabilities Act trial.
