The NLRB incorrectly determined that a Missouri acute care hospital violated federal labor law when it stopped recognizing a union before a decertification election was finalized, a federal appeals court said.
The US Court of Appeals for the Eighth Circuit however in its Wednesday opinion separately upheld the National Labor Relations Board’s determination that the hospital violated federal labor law by refusing to allow a union representative from the National Nurses Organizing Committee to attend a grievance meeting.
