A coalition of state attorneys general, is accusing the EEOC of exceeding its statutory authority by including protections for transgender workers in the agency’s recently proposed enforcement guidance on harassment.
In a letter sent to the Equal Employment Opportunity Commission Wednesday, Tennessee Attorney General Jonathan Skrmetti and 19 other state attorneys general said the agency’s draft guidance violates Title VII of the Civil Rights Act of 1964 because it goes beyond what the statute prohibits.
The letter was submitted as part of a public comment period on the proposal, which closed Wednesday.
