EEOC to Give Employers More Data While Resolving Bias Claims

Employers negotiating potential settlements with the EEOC will receive more information on how the agency determined workplace discrimination allegedly occurred, under a final rule approved by the agency on Thursday.

Proposed changes to the U.S. Equal Employment Opportunity Commission’s conciliation process for resolving disputes before litigation concerned some worker rights groups that business interests would get priority over alleged victims of discrimination. However, some attorneys that represent employers welcomed the greater transparency when interacting with the agency.

The EEOC’s Republican majority cleared the final rule on a 3-2 vote along party lines.
