Advocacy groups can’t challenge the EEOC’s enforcement decisions, including changes to investigations of gender identity related charges, according to a new case filing from the commission.
The Equal Employment Opportunity Commission asked the US District Court for the District of Maryland Wednesday to dismiss a case brought by two civil rights groups, stating that the agency’s discretion over when to investigate or enforce discrimination laws are “core Executive functions generally insulated from judicial review.”
The motion underscores the EEOC’s push to roll back use of Title VII of the 1964 Civil Rights Act for transgender bias charges.
