EEOC Loses Bid for Quick Win on Yale’s Testing of Older Doctors

Yale New Haven Hospital Inc. defeated the EEOC’s request to seek partial summary judgment in a lawsuit challenging as disability discrimination Yale’s policy of subjecting physicians at least 70 years old to eye and neuropsychological testing, the District of Connecticut ruled.

The Equal Employment Opportunity Commission argued that it should be allowed to move for summary judgment on its Americans with Disabilities Act claim because Yale conceded it can’t prove its “Late Career Practitioner Policy” increases patient safety, thereby fatally undermining the hospital’s “business necessity” defense.
