The Equal Employment Opportunity Commission will make its guidance documents available to the public, ensure guidance is treated as non-binding, and require a notice-and-comment period for “significant” guidance, according to a new final rule.
The final rule, issued Friday, also will establish a petition process to allow the public to weigh in on guidance. The regulation will take effect 30 days from its expected publication in the Federal Register on Nov. 2, the agency said.
