EEOC Files Class Lawsuit Under GINA, Alleging Employer Seeks Genetic Information

A Corning, N.Y., nursing home violates the Genetic Information Nondiscrimination Act by asking prospective and current employees for their family medical histories during required pre-employment and annual medical exams, the Equal Employment Opportunity Commission alleged May 16 in a lawsuit filed in federal district court in New York (EEOC v. Founders Pavilion Inc.).

EEOC’s case against Founders Pavilion Inc., brought in the U.S. District Court for the Western District of New York, marks the agency’s first class lawsuit under GINA, which was enacted in 2008 and took effect for employment purposes on Nov. 21, 2009.
