EB-5 Regional Center Termination for Unpaid Fee Blocked by Court

US Citizenship and Immigration Services cannot terminate an immigrant investor enterprise’s authorization as a sanction for failure to pay required program fees, after a federal judge in Montana granted an injunction against the agency.

Missoula, Mont.-based Northern Rockies Regional Center is one of more than 100 EB-5 regional centers facing loss of approval or authorization from USCIS over unpaid program integrity fees, the enterprise said in its lawsuit. Judge Donald W. Molloy of the US District Court for the District of Montana found after arguments Monday that the injunction was warranted pending a final decision on the merits.
