EaglePicher Defeats Founder’s Lawsuit Over Resignation, Payout

EaglePicher Technologies LLC won dismissal of a breach of contract suit brought by the founder of a company it acquired who claimed he was owed a payout because he resigned with good reason.

Christopher Cook failed to sufficiently allege that his resignation was mutually agreed upon, or that he resigned within the window required by his employment agreement to be eligible for payout, the US District Court for the Southern District of New York ruled Tuesday.
