Duke Energy Blocks U.S. Bid to Limit Suit Over Nuclear Waste

Duke Energy Progress Inc. and Duke Energy Florida Inc. stopped the government’s attempt to limit their effort to recover damages from the Energy Department’s failure to accept and remove nuclear waste from a Florida plant.

Duke’s effort to recover costs to mitigate the impact of the department’s alleged contract breach over the waste was barred by the doctrine of collateral estoppel because it involved the same issues as a prior dispute, the government argued in its partial motion to dismiss the suit.
