A proposed class action alleging Doordash Inc. violated California wage law by misclassifying more than 450,000 delivery drivers as independent contractors rather than employees will move forward in state court, after a federal magistrate judge declined jurisdiction.
Company records show that more than two-thirds of the drivers who completed deliveries for Doordash in California listed an address in that state when they registered to work on the platform, hold California drivers’ licenses, and never made any deliveries outside the state.
The case therefore falls within the Class Action Fairness Act’s home state exception, Magistrate Judge Donna M. Ryu said.
