DoorDash Drivers Must Arbitrate Nationwide Classification Suit

DoorDash Inc. won its bid to enforce individual arbitration agreements against nearly 4,0000 takeout-delivery drivers who claim they were deprived of minimum wages because they’re misclassified as independent contractors rather than employees.

The drivers, as a group, don’t cross state lines often enough during the course of their work to qualify as transportation workers engaged in interstate commerce under the Federal Arbitration Act, Judge Edward M. Chen of the U.S. District Court for the Northern District of California said Thursday.

They therefore can’t use the FAA’s exemption for transportation workers to avoid arbitrating their claims, Chen said.
