DoorDash Driver’s Hope to Keep Wage Case in Court Dashed

DoorDash Inc., a restaurant food delivery service, can take a lawsuit alleging it misclassified drivers as independent contractors out of court and into arbitration, a federal judge ruled.

The Oct. 22 decision shoots down what Judge Phyllis J. Hamilton called a “novel legal argument” the driver leading the litigation gave for why the case should stay in court. Manuel Magana, who initially filed the lawsuit that alleges DoorDash owes business expense reimbursement and minimum wage, wanted to add another driver, Jared Roussel, as a named plaintiff.
