A Domino’s franchisee with stores in three states lost its bid for an early end to proposed class claims under New Mexico wage law based on its alleged failure to sufficiently reimburse delivery drivers for vehicle-related expenses.
The delivery driver representing the New Mexico subclass alleges BAM! Pizza Management Inc.'s failure to properly reimburse workers pushed their pay below the state’s minimum wage. The statute’s plain text prohibits any cost-shifting that leads to subminimum wages, so the franchisee isn’t entitled to summary judgment, the US District Court for the District of New Mexico said Wednesday.
