Domino’s Driver Arbitration Pacts Doom Tip Credit Claims for Now

Domino’s Pizza Inc. and two subsidiaries are free of a lawsuit alleging they stiffed delivery drivers on pay after the workers failed to identify a named representative not bound by an arbitration agreement despite months of searching.

The workers asked for permission to amend their complaint with four new lead plaintiffs—all subject to arbitration pacts—or extra time to find replacements qualified to pursue the wage claims in court. But amendment wouldn’t help, and they already got more than three months to look for a viable representative, the US District Court for the Eastern District of Michigan said Tuesday.
