Domino’s Again Loses Bid to Force Wage Case Into Arbitration

A group of Domino’s Pizza LLC ingredient delivery drivers can pursue their wage and hour class action after a federal appeals court found that judicial precedent foreclosed the company’s bid to send the case to arbitration.

The US Court of Appeals for the Ninth Circuit on Friday reinstated its prior finding that the drivers qualify for an exception to the Federal Arbitration Act, which generally favors mandatory arbitration agreements and use of this process rather than litigation.
